The following provisions form the basis of the Club Sanook Purple Points member award program ("Program"). Your participation in the Program will be governed by these provisions, and it is your responsibility to read and understand all of them. Further information/clarification can be obtained by contacting Purple Dragon, but these Program Rules cannot be superseded or changed unless amended rules are posted on the Club Sanook website.

Club Sanook membership and its benefits are offered at the discretion of Purple Dragon, and Purple Dragon has the right to terminate the Program, or to change the Program Rules, regulations, benefits, conditions of participation, or redemption levels, in whole or in part, at any time with or without notice, even when changes may affect the value of the points already accumulated. Purple Dragon may, among other things, withdraw, limit, modify or cancel any award; increase or decrease the points required for any award; add an unlimited number of blackout days; or limit the capacity available.

Each member shall be responsible for keeping up to date with the Program Rules and as to the number of points in his or her account. Purple Dragon shall attempt to transmit account summaries, newsletters, and other correspondence and materials to active members to advise them of various matters of interest, but Purple Dragon shall have no liability for any failure to do so. Purple Dragon and all companies affiliated with Club Sanook will not be responsible for lost or delayed correspondence.

Purple Dragon reserves the right to terminate the program with three months' notice. This means that a Member's right to accumulate points and redeem Awards will be terminated three months after Purple Dragon notifies the member.

Program membership entitles Members to earn points, which can be redeemed for Awards in accordance with the Rules of the Program. Members cannot maintain membership in or earn points on multiple accounts.

The purchase of any arrangements from Purple Dragon does not in itself constitute an earning of points. Only Club Sanook Members may earn points under this program. Points may not be earned retroactively.

Purple Dragon customers earn one Point for each US dollar or equivalent spent on prepaid tour package purchases ("Services"). Only the person contracting for and paying for the Services may accrue points for those Services.

Points shall not be awarded for Services that are not prepaid, for custom group arrangements, for airport transfers, or for airfares purchased. Points shall not be earned on arrangements made by redemption of Program points, hotel-only reservations regardless of prepayment, airfares, airport transfers purchased separately from packages, free or discounted Services including "Club Sanook Member Specials," or other Services specifically identified on the Purple Dragon or Club Sanook website as Services for which no points may be accrued.

The Program will become effective for qualified travel arrangements paid for on or after 1 March 2007. Purple Dragon  will give previous customers a gift of a "starting balance" based on arrangements paid prior to that date. However, no adjustments will be available and no research will be made for the period before 1 March 2007.

To redeem an award, please go to www.clubsanook.com/awards.htm. Redemption of any award is subject to the following conditions:

1. Points become available for redemption 60 days after they are earned, except as described in Paragraph 2.

2. In order to qualify for an Award, the member must have sufficient points in his or her account to redeem that Award. However, Members may redeem an Award at a higher Award level by purchasing additional non-discounted, non-Award arrangements in conjunction with the redemption of any Award. The points earned by purchase of additional arrangements must be equal to or greater than the difference between the points in the Member's account and the points required to redeem the Award desired. Specifically excluded, however, are those arrangements that constitute a part of the Award itself.

3. Awards may be used only by the Member who earned the points being redeemed. There are no joint, group or corporate Memberships.

4. Points earned by two or more different Members may not be combined to redeem any award.

5. All Awards may be subject to certain restrictions. Awards may not be applied to group or already-discounted travel or programs, including programs that are offered to Members only. Reward usage may be subject to capacity controls, which limit the availability of rooms, transportation and guide staff. Additionally, Use of Awards may also be limited during certain times of the year. Blackout dates may be imposed or changed with or without notice.

6. Points can not be redeemed for cash or for non-Award travel.

7. In the event that the Award is not used, points used to redeem Awards may not be re-deposited to the Member's account unless an administrative fee of $50 is paid.

Unredeemed points shall expire and be forfeited 36 months from the date they were earned unless the Program is terminated upon three months notice.

Points accumulated by any Member and program Awards redeemed by any Member are not transferable under any circumstances.

Accrued points do not constitute property of the Member. Accrued points are not transferable (i) upon death, (ii) as part of a domestic relations matter, or (iii) otherwise by operation of law.

Correspondence between Club Sanook and its members shall be primarily by email. Members are required to have an email address. Each Member must have his or her own unique email address. There are no "household" Memberships.

Purple Dragon and Club Sanook may inform members about products and services offered from time to time. Members consent to receiving this information as a condition of Membership. Membership, membership benefits and points accumulated will be forfeited if a Member instructs Purple Dragon and/or Club Sanook to remove his email address from its distribution list.

Each member shall be responsible for advising Club Sanook of any change of email address. When three successive emails from us to a Member are returned as undeliverable, that Member will be considered to have resigned his Membership.

Purple Dragon reserves the right to discontinue Club Sanook Membership for any Member who, in the judgment of Purple Dragon, appears to be using the Program in a manner inconsistent with the Rules or intent of the Program or any portion of the Program. We also reserve the right to discontinue membership for any Member who acts in a manner inconsistent with any laws, statutes or ordinances or Purple Dragon' own Terms and Conditions while using arrangements purchased through Purple Dragon or Club Sanook. Discontinued Membership may result in the loss of all accumulated points.

All interpretations of Program Rules shall be at the sole discretion of Purple Dragon. Purple Dragon and Club Sanook provide this award program "as is" and, to the fullest extent permitted by law, expressly disclaims any warranties of any kind, whether express or implied and including, but not limited to, warranties of merchantability, fitness for any purpose whatsoever, design, accuracy, capability, sufficiency, suitability, capacity, completeness or availability. Purple Dragon and Club Sanook neither warrant nor guarantee that this program and its related services will be uninterrupted, without omissions or free from errors, that any defects will be corrected, or that any changes will be implemented. Membership and this agreement are governed by the laws of the Kingdom of Thailand, which is the only jurisdiction available for resolution of claims or disputes that might arise from use of this program.
